Several members of the court’s conservative majority, including Justice Amy Coney Barrett and Justice Neil M. Gorsuch, joined the liberal justices in sharply questioning the Trump administration’s assertion that it has the power to unilaterally impose tariffs without congressional approval.
I have been a member of the SCOTUS Bar since 1985. I see no change in the Article II powers that would limit Trump, as McKinley was not limited.
Congress has the power to tax. But tariffs are a fee not a tax.
The fee is designed to partially offset any harm that will be caused by the imported goods (lost jobs, etc).
I did not expect the Conservatives on SCOTUS to become so confused.
Trump was elected and sworn in. Let him have the Article II powers!
